CLAUSE 1. PURCHASE PROCESS

1.2. HOW TO ADD PRODUCTS TO YOUR CART

If you have decided to buy a product at https://www.masbertran.com, click on the button “Add to basket”, which is on the page of each product. You can continue searching until the cart contains all the products you want to purchase. You can consult the basket at all times by clicking on the “My basket” button, located at the top right of the page with the image of a cart.

1.3. MAKE A PURCHASE

In order to make a purchase through the website, a user account must be created. To do so, the user is requested to enter a valid email address and password of six or more characters and to accept the privacy policy and these general conditions of purchase.

Once the account is created, you can review both your personal data and order details before confirming it.

CLAUSE 2. AVAILABILITY

The offers of products and prices are valid while they are exposed on the website, and always depending on the available stocks, in accordance with the conditions announced for each product on the website at all times. We reserve the possibility of assigning a maximum of bottles of each wine per customer. The assignments will be made in strict order of receipt of the order.

In the event that, after processing an order, the product is not available, the customer must be immediately informed through email or telephone, and according to the customer’s will, only a part of the order is delivered or cancelled.

If the customer opts for the total or partial cancellation of the order, he must receive the refund of the corresponding amount within the shortest possible time, once all the requirements and obligations derived from this request have been certified.

CLAUSE 3. ORDER DELIVERY

Delivery to the Iberian Peninsula and the Balearic Islands: 3 – 5 working days

Delivery to the Canary Islands and other European countries 5 – 8 working days

Any period indicated is understood to count working days. No deliveries are made on Saturdays, Sundays or holidays.

* During the months of August and December this period may vary.

The products are sent to the address indicated by the customer during the order. In order to optimize delivery, we invite the buyer to indicate an address in which the order can be delivered working Monday to Friday from 9:00 a.m. to 7:00 p.m.

In case the carrier tried to deliver the package and there was no one to receive it, he will leave a note stating the delivery attempt. Please contact the transport agency as soon as possible using the phone number that you will find in the note, in order to agree on a new delivery. If in this second delivery there is no one to receive it, it will leave a note again recording the second attempt of delivery. From then on, your order will remain at the transport agency office for 15 days.

After these days, your order will be returned to our cellar. When you receive your package, you must:

1. Check the conformity of the merchandise received at the time of delivery.

2. Indicate any anomaly in the delivery note, stating your reservations and including your signature.

3. Transport providers do not allow the return of the goods if the customer opens it in their presence, but they can check the box from the outside and if they detect that the box is wet or wet, they do not accept the order.

4. The carrier will notify us of the incident and we will automatically send a new shipment at no cost to you.

MAS BERTRAN does not assume any responsibility for the consequences of possible delays in the shipment.

CLAUSE 4. RETURNS

4.1. GENERAL CONDITIONS OF RETURN

In accordance with the provisions of Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the defense of consumers and users, the customer has a period of withdrawal of fourteen (14) calendar days from the receipt of the merchandise.

Orders can be cancelled at no cost until the shipment is made effective. If we receive cancellation notice once the package is already sent, it will be considered a return. Returns can be made up to 14 calendar days from the receipt of the product.

The right of return may not be exercised when there are indications that the products have been opened, manipulated or exposed to inappropriate conditions.

It is mandatory to return the correctly protected products, in their original packaging, in perfect condition for later sale. No package that does not have any of the sender’s identification elements (name, surname, address, order number) may be accepted.

The return of the requested products will result in the refund of all the amounts paid by the user. The cost of return will be assumed by the user. Returns arising from our error or any defect in the product are excluded from this case. In this case, MAS BERTRAN undertakes to change the defective product for another equal or the amount will be refunded.

The User will receive an email accusing the receipt of the return communication. We will not accept any change or return if we have not previously received any notification.

In accordance with banking legislation, credit cards whose expiration date has expired cannot be reimbursed. In this case, MAS BERTRAN reserves the right to request the customer all the necessary data to make the corresponding refund.

4.2. DEFECTIVE PRODUCT OR ORDER
At MAS BERTRAN we taste the batches we serve regularly. However, it is possible that some bottles do not arrive in good condition at their destination. In this case, MAS BERTRAN undertakes to change the defective product for another one of equal, at no cost, or refund the amount, assuming the costs of return and subsequent shipment, if applicable.

The delivery packaging is designed to avoid breakage and our partners are very aware of the fragility of the product; however, it is possible that some breakage occurs.

CLAUSE 5. PRODUCTS

The products offered are in accordance with current Spanish legislation and the rules applicable in Spain.

MAS BERTRAN makes every effort to ensure that the photographic images of its products faithfully represent the products offered. Likewise, each product is accompanied by an exact description of its main characteristics.

In the event of an obvious lack of correspondence between the characteristics of the product and its representation, the customer may return it and request its reimbursement in accordance with the provisions of clause 4.

CLAUSE 6. PRICE

6.1. The prices of the products are indicated in euros with all taxes included; management and delivery expenses are not included, the amount of which is indicated at the time of the definitive confirmation of each order, according to the amount requested, the delivery method selected by the customer and the delivery address.

6.2. MAS BERTRAN reserves the right to modify prices at all times, but the products must be billed in accordance with the rates in force at the time the order is registered and in no case the orders already made are modified. 6.3. The ownership of the product is transmitted to the customer at the time of delivery, provided that the payment has been made in advance. Otherwise, the transfer of the property is conditioned to the payment of the price.

CLAUSE 7. PAYMENT

7.1. PAYMENT MODE

Payment of purchases is made by payment card, PayPal or bank transfer.

Likewise, MAS BERTRAN reserves the right to cancel or reject any order from a customer with whom it maintains a litigation regarding the payment of a previous order. At the time the customer presses the “ACCEPT” button, during the order confirmation, the validity of the credit card number is verified and it is verified that it is not blocked. This action is carried out in the payment gateway of the bank “Caixabank”.

MAS BERTRAN does not have access to the client’s banking data in any case, nor does it store it on its servers. For this reason, the customer must provide them again each time he makes a new transaction on our website.

In this way, you obtain double protection against abuse and fraud.

7.2. SECURE PAYMENT

In accordance with our commitment regarding payment security, we inform you that “Caixabank” is responsible for verifying the reliability of the data provided during the making of a card payment.

MAS BERTRAN reserves the right to ask its customers to send (by fax, postal or email) a copy of both sides of their national identity document, as well as a proof of their home of less than three months (3) of antiquity. No order can be delivered before the reception and checking of these documents. The requested documents must be sent within six (6) business days.

MAS BERTRAN reserves the right to reimburse the order if it does not receive the aforementioned documents, or if they are not valid.

CLAUSE 8. MODIFICATIONS
